Re: Tie Vote on HR 5719 on the House Floor

 

Date: April 15, 2008

1) The opposition to this bill focused on the motion to recommit, which is a vote to send the bill back to Committee, in the Ways and Means Committee. This vote was 210 to 210, and the motion, because it was a tie, failed. This means that the bill was not sent back to Committee and was then voted on for final passage. The correct way to vote on this vote (Roll Call vote 189) was Yea. The yeas votes below voted the way we wanted them to vote.

2) The vote on the Motion to recommit was won by us at the end of the 15 minutes allotted for the vote. The vote was held open until enough votes were rounded up to make it a tie, and thus a loss. One member of Congress, Representative Westmoreland (R-GA) attempted to challenge the Chair that House Rule 2o was violated, in that a vote was held open until its outcome changed, but his efforts failed. (This is not a rare occurrence, votes are held open all the time until the Leadership gets the result they want by pressuring Members to change their vote, or by waiting for a Non-voting member to get to the House Chamber.)

3) On motion to recommit, 21 House Democrats voted to send the bill back to Committee. This is the vote that the HSA Coalition will key vote. Unfortunately, three Republicans voted against the motion to recommit, they voted the wrong way.

4) Once the motion to recommit failed by a tie, final passage was rout – 238 to 179.

5) It important to remember that the President has threatened to veto this bill over the HSA provision in H.R. 5719. This means that the bill, if vetoed, will not become law, since any effort to override the President’s veto will fail in the House.

6) The bill also must pass the Senate, and then go to conference, and the HSA substantiation provision must survive all of that for it then to be vetoed. This has been a useful exercise in fighting this legislation, as it shows what we must do to be effective on the Hill.
